Worked example

India: wages of $30,000 a month, divided by 26 days of 8 hours, and 20 hours of overtime
Hourly rate = 30,000 ÷ (26 × 8) = 30,000 ÷ 208 = $144.23
Overtime rate = 2 × 144.23 = $288.46 an hour
Overtime pay = 288.46 × 20 = $5,769
Wage plus overtime = $35,769

Which wage the overtime rate is based on

Every overtime rule multiplies an hourly rate, but the rules start from different wages, and that matters more than the multiplier. India. Under the Labour Codes, in force since 21 November 2025, a worker who works beyond the normal hours — 8 in a day or 48 in a week — must be paid for the extra hours at twice the rate of wages. “Wages” in the Codes means basic pay, dearness allowance and retaining allowance; allowances such as house rent and conveyance are left out, but if the excluded parts come to more than half of total pay, the excess is counted back in. So the base can be larger than basic pay alone. Overtime needs the worker’s consent, and the overtime rules apply to workers, not to managerial or supervisory staff above the Codes’ thresholds.

UAE. Federal Decree-Law 33 of 2021 pays an overtime hour at the normal hourly wage worked out on the basic wage, plus at least 25%, or at least 50% between 10 pm and 4 am (shift workers excepted). Allowances are not part of the base. Saudi Arabia. The Labor Law pays the hourly wage plus 50% of the basic wage for the hour. With allowances in the package that is less than time and a half of full pay: on 6,000 basic and 3,000 allowances, 10 hours come to 500, against 312.50 under the UAE’s day rule. The table shows each rule on the same pay.

The divisor. The monthly wage is turned into an hourly rate by dividing by days and then by hours. Indian payroll often uses 26 working days; the UAE law counts a month as 30 days. A smaller divisor gives a higher hourly rate, so check the one in your contract or pay policy and enter it. Overtime is also capped: the Codes, the UAE and Saudi laws all limit how many hours can be worked, and rest days have their own rules.

How is overtime calculated in India under the new Labour Codes?

At twice the rate of wages for every hour beyond the normal day or week. On $30,000 a month divided by 26 days of 8 hours, the hourly rate is $144.23, so an overtime hour pays $288.46.

Is overtime paid on basic salary or gross?

It depends on the country. India’s Codes use wages as they define them (basic, DA and retaining allowance, with a 50% rule). The UAE uses basic wage. Saudi Arabia pays the full hourly wage plus 50% of the basic hourly wage.

What is the overtime rate in the UAE?

The basic hourly wage plus at least 25%, or plus at least 50% for overtime between 10 pm and 4 am. Work on a rest day earns another rest day, or the day’s wage plus at least 50% of the basic wage for that day.

Why does the divisor matter?

Because it sets the hourly rate. The same monthly wage divided by 26 days gives a higher hourly rate than divided by 30. Use the divisor your contract or pay policy states.
